Is online gambling legal in Guatemala?
Guatemala is one of the least regulated gambling markets in Latin America. Article 477 of the Penal Code, inherited from 1880-era rules, makes running unauthorized gambling houses and games of chance an offence, yet no modern law creates a licence, a regulator or rules for casinos, sports betting or online play. Casinos and betting shops operate openly in the main cities under municipal commercial permits and tax registration, and Guatemalans use internationally licensed betting sites without a local framework. The only expressly legal game is the Lotería Santa Lucía, run since 1956 by the Benemérito Comité Pro Ciegos y Sordos. Congress's Iniciativa 6645, which received a favorable committee opinion on 4 November 2025, would toughen Penal Code sanctions on slot machines and simulated lotteries rather than create a licensing regime; the broader Iniciativa 4294 was never approved.

Who regulates gambling in Guatemala?
- Ministerio de Gobernación (departmental governors) and the Congreso de la República — No gambling regulator exists; departmental governors authorize raffles and supervise lottery draws, the Contraloría General de Cuentas audits the Lotería Santa Lucía, and Congress is the body considering gambling bills
Guatemala gambling licence: how it works
No licence for casino, sports betting, poker or online gambling exists in Guatemala and no authority is empowered to grant one. Land-based casinos and betting shops operate under general commercial permits, municipal licences and tax registration with the SAT, in a gap between the Penal Code's prohibition and the absence of enforcement. Lotteries and raffles are the exception: the Lotería Santa Lucía holds the legal lottery, and one-off raffles need permits from departmental governors. Two attempts to create a regime have stalled. Iniciativa 4294 proposed a Ley de Regulación de Apuestas, Casinos, Videoloterías, Bingos y Juegos de Azar with a national gaming commission and superintendency but was never approved. Iniciativa 6645, filed on 23 September 2025 and given a favorable opinion by the Comisión de Gobernación on 4 November 2025, adds Penal Code offences for tax fraud through gambling, operating slot machines, giving minors access and simulating lotteries with virtual games, with prison terms of up to five to ten years; it does not create a licence. Whether an internationally licensed operator may accept Guatemalan residents is a question for the operator's counsel.
What an applicant needs
- No gambling licence exists; venues rely on municipal commercial permits and SAT tax registration
- Raffles and one-off draws require a permit from the departmental governor
- Lottery is reserved to the Lotería Santa Lucía of the Comité Pro Ciegos y Sordos
- Any future regime depends on Congress passing a gambling law
Gambling taxes in Guatemala
- Operators: No gambling-specific tax. Businesses pay general income tax (25% on net profits or the simplified regime on gross income) and 12% VAT under the Ley de Actualización Tributaria (Decree 10-2012); Iniciativa 6645 would treat unauthorized gaming machines as tax fraud with fines of twice the tax evaded.
- Players: Prizes from lotteries, raffles and similar draws are taxed as capital income at 10% under Decree 10-2012; no rule addresses winnings from casino or online play.
- Also: The Lotería Santa Lucía distributes 65% of ticket income to prizes and 14% to the Comité's health, education and rehabilitation programs; its draws are supervised by the Contraloría General de Cuentas and the departmental government.
Advertising, player protection, KYC and payments
Advertising
No gambling advertising rules exist beyond general consumer and broadcasting law; lottery advertising by the Comité Pro Ciegos y Sordos is unrestricted.
Responsible gaming
No statutory framework. Iniciativa 6645 would penalize venues that let children and adolescents use gaming machines with closure and up to five years' imprisonment, reflecting concern about slot machines in neighborhood shops.
Identity and age verification
No gambling-specific rule; Guatemala's AML law (Decree 67-2001) and the Intendencia de Verificación Especial cover regulated financial businesses, and casinos are not a licensed category.
Payments
No gambling payment rules. Cards, bank transfers and mobile banking are common in the formal economy, and cash dominates elsewhere; crypto is not addressed by gambling law.
Notable restrictions
- Unauthorized games of chance and gambling houses are offences under Penal Code article 477
- No licence can be obtained for casino, betting, poker or online gambling
- Lottery is a monopoly of the Lotería Santa Lucía; raffles need a governor's permit
- Iniciativa 6645 would add prison terms for slot-machine operation, minors' access and simulated lotteries
Guatemala iGaming market: size, players and payments
No reliable public estimate; there is no regulator collecting revenue data and industry reports describe most online betting as taking place on internationally licensed sites.
Casinos and betting shops operate in Guatemala City and other cities without licences, the Lotería Santa Lucía sells 80,000 tickets per draw through about 435 wholesale sellers, and no locally authorized online brand exists.
Timeline: how Guatemala got here
- 1880Rules that still underpin the Penal Code's treatment of games of chance are adopted
- 1956-09Lotería Santa Lucía created by Decree 577 to fund the Comité Pro Ciegos y Sordos
- 1973Penal Code (Decree 17-73) codifies offences for unauthorized gambling houses and lotteries
- 2025-09Iniciativa 6645 filed to add Penal Code offences on slot machines, minors and simulated lotteries
- 2025-11Comisión de Gobernación issues a favorable opinion on Iniciativa 6645 (4 November)
Outlook
Iniciativa 6645 awaits plenary debate; if approved it would sharpen criminal enforcement against slot machines and simulated lotteries but leave online gambling unaddressed. Industry and anti-money-laundering commentators called in 2025 and 2026 for a licensing law modeled on Colombia's, and the government has said it is studying options, but no comprehensive bill was before Congress as of September 2026. Treat Guatemala as unregulated with criminal-law risk rather than as an opening market.
Launching in Guatemala with GameBridge
Model decided with counsel. Guatemala offers no licence and its Penal Code penalizes unauthorized games of chance, so GameBridge cannot recommend a launch model; whether an internationally licensed operator may accept Guatemalan residents is for the operator's counsel to decide.
Guatemala is excluded in GameBridge geo-controls by default. If an operator's counsel concludes that its international licence permits Guatemalan residents, the brand can be enabled for Guatemala with Spanish as the site language, a quetzal or US dollar wallet, KYC before play, per-brand responsible-gaming limits and AML case management, and the compliance dossier records the legal opinion, geo lists and payment rails for banks and processors. Content is curated to the licensing regulator's requirements, and GameBridge Studios and Originals ship with certification packages for that regulator's test house.
- Geo allow and deny lists with Guatemala excluded by default
- Spanish site language with GTQ and USD wallets on request
- KYC before play and AML case management
- Per-brand responsible-gaming limits and self-exclusion
- Compliance dossier recording counsel's opinion and payment rails
Football betting and slots lead Guatemalan interest; content is curated to the operator's licensing regulator and GameBridge Studios exclusives ship certification-ready for that regulator's test house.
